STATE OF FLORIDA               COUNTY OF MIAMI DADE   BEFORE ME, the undersigned authority, personally appeared RODOLFO SUAREZ, JR., ESQ., who after being by me duly sworn, deposes and says:

  1. Affiant has been retained by MARY STRAWDER, as Personal Representative of the Estate of Mable Mae Montgomery, who is the daughter of the decedent, to represent her in the administration of the Estate of Mable Mae Montgomery.
  2. MARY STRAWDER was appointed the personal representative of this estate pursuant to the Letters of Administration entered on September 14, 2016.
  3. The estate was opened so the personal representative could pursue a nursing home/wrongful death claim on behalf of the estates survivor(s).
  4. On September 14, 2015, Mable Mae Montgomery died as a result of numerous unexplained injuries to her lower extremities which could only have occurred if she was dropped from a Hoyer lift by the Defendants staff due to her immobility and inability to bear her own weight as a result from the negligence of Terrace Health NH, LLC, a Foreign Limited Liability Company d/b/a Terrace Health & Rehabilitation Center. The decedent was ninety-four (94) years old at the time of her death.  
  5. The decedent had five (5) children, to wit: Mary Strawder, Georgia Blake, George Jones, Mattie Walker and Henry Montgomery.
  6. Henry Montgomery passed away on or about August 9, 2013. Mr. Montgomery was survived by four (4) children, to wit: Henry Montgomery, Jr., Garrett Montgomery, Tonicha Montgomery and Tonya Montgomery Powell.
  7. Petitioner was able to obtain the mailing addresses for the following:
  8. Henry Montgomery 6095 S. Twin Lake Road, Keystone Heights, Florida 32656;
  9. Garrett Montgomery 638 N.E. 16 Terrace, Gainesville, Florida 32641;
  10. Tonicha Richardson 1432 N.E. 19 Place, Gainesville, Florida 32608; and
  11. Tonya Montgomery Powell 3503 Thunder Creek Drive, Killeen, Texas 76549.
  12. Undersigned counsel has mailed out copies of the following pleadings to Mr. Montgomerys children:

  14. Formal Notice;
  15. Amended Petition for Administration; and
  16. Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement.
  17. On November 12, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Tonya Montgomery Powell. A copy of the Proof of Service is attached hereto as

  1. On November 12, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Garrett Montgomery. A copy of the Proof of Service is attached hereto as Exhibit B.
  2. On November 12, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Tonicha Richardson. Furthermore, Ms. Richardson signed the Consent to Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement which was filed with the Court on November 26, 2019. Copies of the Proof of Service and Consent are attached hereto as

Exhibit C.

  1. On November 26, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Henry Montgomery. Furthermore, Mr. Montgomery signed the Consent to Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement which was filed with the Court on November 26, 2019. Copies of the Proof of Service and Consent are attached hereto as

Exhibit D.

  1. Undersigned counsel would like to bring to the Courts attention that neither Mr. Montgomery nor his children qualify as survivors pursuant to Florida Statute 768.18(1).
  2. The underlying lawsuit has since settled for a gross settlement amount of $55,000.00, which was approved by this Court on November 7, 2018.
  3. During the administration of this estate, Ms. Georgia Blake was represented by Michelle L. Farkas, Esq.
  4. During the hearing held on November 7, 2018, this Court entered an Order on Motion to Withdraw as Counsel relieving Ms. Farkas from her representation of Ms. Blake.
  5. There is approximately $12,336.87 pending distribution to the four (4) survivors, which is being held in trust by Fenster and Cohen, P.A. until the Court approves distribution.
  6. On November 16, 2018, an Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement was filed with this Court requesting the proposed apportionment be approved.
  7. Formal Notice of the Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement was sent to Georgia Blake, George Jones and Mattie Walker.
  8. Proof of Service on George Jones and Mattie Walker was filed with the Court on November 28, 2018.
  9. Unfortunately, service of the amended petition on Georgia Blake has been unsuccessful as Ms. Blake will not accept any service. 22. On August 26, 2019, this Court entered an Order Appointing Process Server authorizing Steve Lehr and Shawn Mazzerle to serve Georgia Blake with copies of the Formal Notice and Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement.
  10. On September 13, 2019, undersigned counsel received an email from Precision Process Service, Inc. informing that Georgia Blake had moved out of the residence that is on record as of February 2019. A copy of the email and the Affidavit of Non-Service is attached hereto as Exhibit E.
  11. The Personal Representative has reached out to Georgia Blakes daughter Eugena Blake, who declined to provide any contact information for her mother.
  12. The Personal Representative, through undersigned counsel, requests this Court waive service of the pleadings on Ms. Blake and proceed with depositing Ms. Blakes portion of the funds in the Court registry to avoid further delay in the administration of this estate.

                                AFFIDAVIT OF DILIGENT SEARCH

STATE OF FLORIDA               COUNTY OF MIAMI DADE   BEFORE ME, the undersigned authority, personally appeared RODOLFO SUAREZ, JR., ESQ., who after being by me duly sworn, deposes and says:

  1. Affiant has been retained by MARY STRAWDER, as Personal Representative of the Estate of Mable Mae Montgomery, who is the daughter of the decedent, to represent her in the administration of the Estate of Mable Mae Montgomery.
  2. MARY STRAWDER was appointed the personal representative of this estate pursuant to the Letters of Administration entered on September 14, 2016.
  3. The estate was opened so the personal representative could pursue a nursing home/wrongful death claim on behalf of the estates survivor(s).
  4. On September 14, 2015, Mable Mae Montgomery died as a result of numerous unexplained injuries to her lower extremities which could only have occurred if she was dropped from a Hoyer lift by the Defendants staff due to her immobility and inability to bear her own weight as a result from the negligence of Terrace Health NH, LLC, a Foreign Limited Liability Company d/b/a Terrace Health & Rehabilitation Center. The decedent was ninety-four (94) years old at the time of her death.  
  5. The decedent had five (5) children, to wit: Mary Strawder, Georgia Blake, George Jones, Mattie Walker and Henry Montgomery.
  6. Henry Montgomery passed away on or about August 9, 2013. Mr. Montgomery was survived by four (4) children, to wit: Henry Montgomery, Jr., Garrett Montgomery, Tonicha Montgomery and Tonya Montgomery Powell.
  7. Petitioner was able to obtain the mailing addresses for the following:
  8. Henry Montgomery 6095 S. Twin Lake Road, Keystone Heights, Florida 32656;
  9. Garrett Montgomery 638 N.E. 16 Terrace, Gainesville, Florida 32641;
  10. Tonicha Richardson 1432 N.E. 19 Place, Gainesville, Florida 32608; and
  11. Tonya Montgomery Powell 3503 Thunder Creek Drive, Killeen, Texas 76549.
  12. Undersigned counsel has mailed out copies of the following pleadings to Mr. Montgomerys children:
  13. Notice of Administration;
  14. Formal Notice;
  15. Amended Petition for Administration; and
  16. Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement.
  17. On November 12, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Tonya Montgomery Powell. A copy of the Proof of Service is attached hereto as

Exhibit A.

  1. On November 12, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Garrett Montgomery. A copy of the Proof of Service is attached hereto as Exhibit B.
  2. On November 12, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Tonicha Richardson. Furthermore, Ms. Richardson signed the Consent to Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement which was filed with the Court on November 26, 2019. Copies of the Proof of Service and Consent are attached hereto as

Exhibit C.

  1. On November 26, 2019, Proof of Service was filed with the Court proving service of the above listed documents to Henry Montgomery. Furthermore, Mr. Montgomery signed the Consent to Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement which was filed with the Court on November 26, 2019. Copies of the Proof of Service and Consent are attached hereto as

Exhibit D.

  1. Undersigned counsel would like to bring to the Courts attention that neither Mr. Montgomery nor his children qualify as survivors pursuant to Florida Statute 768.18(1).
  2. The underlying lawsuit has since settled for a gross settlement amount of $55,000.00, which was approved by this Court on November 7, 2018.
  3. During the administration of this estate, Ms. Georgia Blake was represented by Michelle L. Farkas, Esq.
  4. During the hearing held on November 7, 2018, this Court entered an Order on Motion to Withdraw as Counsel relieving Ms. Farkas from her representation of Ms. Blake.
  5. There is approximately $12,336.87 pending distribution to the four (4) survivors, which is being held in trust by Fenster and Cohen, P.A. until the Court approves distribution.
  6. On November 16, 2018, an Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement was filed with this Court requesting the proposed apportionment be approved.
  7. Formal Notice of the Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement was sent to Georgia Blake, George Jones and Mattie Walker.
  8. Proof of Service on George Jones and Mattie Walker was filed with the Court on November 28, 2018.
  9. Unfortunately, service of the amended petition on Georgia Blake has been unsuccessful as Ms. Blake will not accept any service. 22. On August 26, 2019, this Court entered an Order Appointing Process Server authorizing Steve Lehr and Shawn Mazzerle to serve Georgia Blake with copies of the Formal Notice and Amended Petition to Apportion Nursing Home Negligence Wrongful Death Settlement.
  10. On September 13, 2019, undersigned counsel received an email from Precision Process Service, Inc. informing that Georgia Blake had moved out of the residence that is on record as of February 2019. A copy of the email and the Affidavit of Non-Service is attached hereto as Exhibit E.
  11. The Personal Representative has reached out to Georgia Blakes daughter Eugena Blake, who declined to provide any contact information for her mother.
  12. The Personal Representative, through undersigned counsel, requests this Court waive service of the pleadings on Ms. Blake and proceed with depositing Ms. Blakes portion of the funds in the Court registry to avoid further delay in the administration of this estate.
