RESOLUTION 2020-04         BEFORE THE TOWN COMMISSION

A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF MICANOPY, FLORIDA, RECORDING A SPECIAL ASSESSMENT LIEN ON REAL ESTATE LOCATED AT 704 NW 1ST STREET PARCEL #16620-044-001 FOR REIMBURSEMENT OF THE COST OF FEES AND HOUSE DEMOLITION IN THE AMOUNT OF $2,133.71 INCURRED BY THE TOWN OF MICANOPY; OFFICIAL OWNER OF RECORD IS WILLIE BROWN, JR.; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the property located at 704 NW 1st Street was determined to constitute a hazard pursuant to Chapters 5 and 20 of the Micanopy Code of Ordinances and found to be derelict and unsalvageable as a result of neglect. Specifically, the condition of the property violated Chapter 5, Article II, Section 5-20(a) and Section 5-20(b); Chapter 20, Article I, Section 20-2 and Section 20-3; Chapter 20, Article II, Section 20-22 and Section 20-24 of the Micanopy Code of Ordinances; and

WHEREAS, the owner of record is Willie Brown, Jr., 15407 NW 58th Avenue, Alachua, Florida 32615-7721; and

WHEREAS, notice was sent on May 14, 2014 requiring that corrective action be taken within ninety (90) days; and

WHEREAS, failure to correct these conditions within the allotted time resulted in the Town of Micanopy performing demolition work at a cost to the town in the amount of $1,535.12; and  

WHEREAS, Section 5-27 of the Micanopy Code of Ordinances sets forth procedures for the Town of Micanopy to seek special assessment against the property located at 704 SW 1st Street parcel #16620-044-001 because of failure to reimburse the Town of Micanopy for demolition costs totaling $1,535.12; and

WHEREAS, per Micanopy Code of Ordinances Section 5-27 a public hearing was held on January 13, 2015 at which the Town Commission decided to assess a lien; and

WHEREAS, Resolution 2015-02, which was adopted by the Town Commission of the Town of Micanopy on January 13, 2015 and recorded as Instrument Number 2908695 in the office of the Clerk of the Circuit Court in and for the County of Alachua, State of Florida in Official Records Book 4330, page 464, intended levy an assessment against the property located at 704 SW 1st Street parcel #16620-044-001; and

WHEREAS, Resolution 2015-02 inadvertently included an incorrect legal description, resulting in the lien attaching to another property; and

WHEREAS, a release of lien was adopted by the Town Commission and recorded to correct the incorrect lien;

WHEREAS, the Town Commission desires to levy an assessment against the property located at 704 SW 1st Street parcel #16620-044-001.

NOW, THEREFORE, BE IT RESOLVED by the Town Commission of the Town of Micanopy, Florida, that:

  1. The Town Commission finds that:
  2. The procedures of Article 5 of the Micanopy Code of Ordinances have been followed,
  3. That the work done was in conformity with the requirements of Article 5 of the Micanopy

Code of Ordinances,

  1. That the following costs were incurred by the Town:
  2. Administrative fees and service of papers upon the owner in the amount of $126.49;
  3. Publication costs in the amount of $453.60 for Resolution 2015-02;

iii.            Recording costs in the amount of $18.50 for Resolution 2015-02;

  1. Demolition costs in the amount of $1,535.12.
  2. That an assessment of $2,133.71 is just and reasonable and based on the actual cost of the original proceedings. Additional costs associated with publication and recording of this corrective resolution have not been included and will be paid by the Town of Micanopy.
  3. An assessment in the amount of $2,133.71 is hereby levied against the property legally described as:

  2. The owner may pay the amount of such lien, including interest, in thirty (30) consecutive monthly

installments, commencing on the first day of the month following the adoption of such resolution.

  1. A copy of this resolution shall be served on the owner by certified mail within ten (10) days of the adoption date.
  2. A copy of this resolution shall be published once a week for four (4) consecutive weeks in a newspaper of general circulation within the Town of Micanopy.
  3. A certified copy of this resolution shall be recorded in the public records.
  4. This Resolution 2020-04 shall take effect immediately upon its adoption.

RESOLUTION 2020-04         BEFORE THE TOWN COMMISSION

A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF MICANOPY, FLORIDA, RECORDING A SPECIAL ASSESSMENT LIEN ON REAL ESTATE LOCATED AT 704 NW 1ST STREET PARCEL #16620-044-001 FOR REIMBURSEMENT OF THE COST OF FEES AND HOUSE DEMOLITION IN THE AMOUNT OF $2,133.71 INCURRED BY THE TOWN OF MICANOPY; OFFICIAL OWNER OF RECORD IS WILLIE BROWN, JR.; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the property located at 704 NW 1st Street was determined to constitute a hazard pursuant to Chapters 5 and 20 of the Micanopy Code of Ordinances and found to be derelict and unsalvageable as a result of neglect. Specifically, the condition of the property violated Chapter 5, Article II, Section 5-20(a) and Section 5-20(b); Chapter 20, Article I, Section 20-2 and Section 20-3; Chapter 20, Article II, Section 20-22 and Section 20-24 of the Micanopy Code of Ordinances; and

WHEREAS, failure to correct these conditions within the allotted time resulted in the Town of Micanopy performing demolition work at a cost to the town in the amount of $1,535.12; and  

WHEREAS, Section 5-27 of the Micanopy Code of Ordinances sets forth procedures for the Town of Micanopy to seek special assessment against the property located at 704 SW 1st Street parcel #16620-044-001 because of failure to reimburse the Town of Micanopy for demolition costs totaling $1,535.12; and

WHEREAS, per Micanopy Code of Ordinances Section 5-27 a public hearing was held on January 13, 2015 at which the Town Commission decided to assess a lien; and

WHEREAS, Resolution 2015-02, which was adopted by the Town Commission of the Town of Micanopy on January 13, 2015 and recorded as Instrument Number 2908695 in the office of the Clerk of the Circuit Court in and for the County of Alachua, State of Florida in Official Records Book 4330, page 464, intended levy an assessment against the property located at 704 SW 1st Street parcel #16620-044-001; and

WHEREAS, Resolution 2015-02 inadvertently included an incorrect legal description, resulting in the lien attaching to another property; and

WHEREAS, a release of lien was adopted by the Town Commission and recorded to correct the incorrect lien;

WHEREAS, the Town Commission desires to levy an assessment against the property located at 704 SW 1st Street parcel #16620-044-001.

NOW, THEREFORE, BE IT RESOLVED by the Town Commission of the Town of Micanopy, Florida, that:

  1. The Town Commission finds that:
  2. The procedures of Article 5 of the Micanopy Code of Ordinances have been followed,
  3. That the work done was in conformity with the requirements of Article 5 of the Micanopy

Code of Ordinances,

  1. That the following costs were incurred by the Town:
  2. Administrative fees and service of papers upon the owner in the amount of $126.49;
  3. Publication costs in the amount of $453.60 for Resolution 2015-02;
