This matter is before the court on Plaintiff State of Maines Motion for Service by Publication and Enlargement of Time to File the Return of Service.

A complaint has been filed by Plaintiff State of Maine against the Defendant, Mark Douglas Bryant, to collect unpaid Maine sales tax, income withholding tax, interest, and penalties pursuant to 36 M.R.S.A. 174. The Court finds that despite due diligence, the State has been unable to effect service of the summons and complaint upon Mark Douglas Bryant because his whereabouts and place of abode are uncertain and cannot be ascertained by reasonable diligence.

Service by publication is the most effective means of serving Mark Douglas Bryant in accordance with M.R. Civ. P. 4 at this time.

The interests of justice will be best served if the court orders service by publication in this matter.

Accordingly, it is ORDERED:

1. That Mark Douglas Bryant (1) prepare and file an original written Answer to the complaint with the Kennebec County Superior Court, 95 State Street, Augusta, Maine 04330 no later than twenty (20) days after receiving notice of this Order or sixty-one (61) days of this Order (whichever is sooner), and (2) serve a copy of his Answer upon the Attorney for Plaintiff State of Maine, Scott W. This matter is before the court on Plaintiff State of Maines Motion for Service by Publication and Enlargement of Time to File the Return of Service.

A complaint has been filed by Plaintiff State of Maine against the Defendant, Mark Douglas Bryant, to collect unpaid Maine sales tax, income withholding tax, interest, and penalties pursuant to 36 M.R.S.A. 174. The Court finds that despite due diligence, the State has been unable to effect service of the summons and complaint upon Mark Douglas Bryant because his whereabouts and place of abode are uncertain and cannot be ascertained by reasonable diligence.

Service by publication is the most effective means of serving Mark Douglas Bryant in accordance with M.R. Civ. P. 4 at this time.

The interests of justice will be best served if the court orders service by publication in this matter.

Accordingly, it is ORDERED:

1. That Mark Douglas Bryant (1) prepare and file an original written Answer to the complaint with the Kennebec County Superior Court, 95 State Street, Augusta, Maine 04330 no later than twenty (20) days after receiving notice of this Order or sixty-one (61) days of this Order (whichever is sooner), and (2) serve a copy of his Answer upon the Attorney for Plaintiff State of Maine, Scott W. Boak, Assistant Attorney General, 6 State House Station, Augusta, Maine 04333-0006.

2.
