REQUEST FOR RELEASE OF FUNDS

On or about February 3, 2020, the Town of Micanopy will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to make the following improvements:

Service Area #1 Potable Water Distribution System Wide Service Area:

03J Water Tank/Well/Treatment Plant Improvements The activity to be carried out in Service Area #1 is to replace well #2 with a new supply well within the current well field located at 501 NW Seminary Avenue, Micanopy, Florida. The work will include the following:

Drilling of a new well;

Installation of a new well pump on the new well;

Associated yard piping; and

Required electrical improvements.

03J Water Tank/Well/Treatment Plant Improvements The activity to be carried out in Unmet Need #1, Service Area #1 involves the installation of a water tank mixer to circulate and blend the finished water in the existing elevated storage tank. The mixer will prevent the water from becoming stagnant which can decrease the chlorine residual in the tank.

The Town of Micanopys water tank is located at 501 NW Seminary Avenue, Micanopy, Florida.

03J Water Line Replacement The activity to be carried out in Unmet Need #2, Service Area #1 involves replacement of all the existing residential potable water meters in the service area with new radio read water meters, meter boxes, curb stops and backflow preventors. Additionally, the activity includes funding for an automatic meter reader data collector, software and hardware required to read the water meters and develop the water bills for distribution.

Unmet Need #2 Service Area #1 includes all of the homes that are served by the Town of Micanopy potable water system.

A portion of the activities in Unmet Need #2 Service Area #1 may be carried out within a floodplain and/or wetland. Approximately 15 acres of land located within a floodplain and/or wetland may be included in the construction area.

The Town does not anticipate any additional impervious areas will be created in the Service Area included in this project. If the case where new impervious surfaces are created, storm drainage improvements will be included in the design and construction of the project to offset the impact of the additional impervious services being created.

Failure to provide these improvements would result in the Town of Micanopy not being able to carry out the activities in the project.

FINDING OF NO SIGNIFICANT IMPACT

The Town of Micanopy has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Town of Micanopy Town Hall located at 706 NE Cholokka Blvd, Micanopy, FL 32667-0137 and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Debbie Gonano, Town Administrator, Town of Micanopy, P. O. Box 137, Micanopy, FL 32667-0137. All comments must be received by February 1, 2020. Comments will be considered prior to the Town of Micanopy requesting a release of funds. Comments should specify which notice they are addressing.

RELEASE OF FUNDS

The Town of Micanopy certifies to the Florida Department of Economic Opportunity and HUD that Joseph Aufmuth in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The States approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Micanopy to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS

DEO will accept objections to its release of funds and the Town of Micanopy certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Micanopy; (b) the Town of Micanopy has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contact the Town of Micanopy to verify the actual last day of the objection period.

Additionally, the activity includes funding for an automatic meter reader data collector, software and hardware required to read the water meters and develop the water bills for distribution.

Unmet Need #2 Service Area #1 includes all of the homes that are served by the Town of Micanopy potable water system.

A portion of the activities in Unmet Need #2 Service Area #1 may be carried out within a floodplain and/or wetland. Approximately 15 acres of land located within a floodplain and/or wetland may be included in the construction area.

The Town does not anticipate any additional impervious areas will be created in the Service Area included in this project. If the case where new impervious surfaces are created, storm drainage improvements will be included in the design and construction of the project to offset the impact of the additional impervious services being created.

Failure to provide these improvements would result in the Town of Micanopy not being able to carry out the activities in the project.

FINDING OF NO SIGNIFICANT IMPACT

The Town of Micanopy has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Town of Micanopy Town Hall located at 706 NE Cholokka Blvd, Micanopy, FL 32667-0137 and may be examined or copied weekdays 8:30 A.M. to 5:00 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Debbie Gonano, Town Administrator, Town of Micanopy, P. O. Box 137, Micanopy, FL 32667-0137. All comments must be received by February 1, 2020. Comments will be considered prior to the Town of Micanopy requesting a release of funds. Comments should specify which notice they are addressing.

RELEASE OF FUNDS

The Town of Micanopy certifies to the Florida Department of Economic Opportunity and HUD that Joseph Aufmuth in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The States approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Micanopy to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS

DEO will accept objections to its release of funds and the Town of Micanopy certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Micanopy; (b) the Town of Micanopy has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400, 107 East Madison Street, Tallahassee, FL 32399-6508.
